Why Hire a Lawyer for a Bankruptcy Case?

While you are under no requirement to hire a lawyer to assist you with a bankruptcy case and you can file on your own - what’s called in the law “Pro Se” - you will likely be better off hiring an lawyer to assist you.

A good bankruptcy lawyer can provide you with the information you need to make the best choices for your situation. Bankruptcy is a complex legal process that requires a lot of paperwork to be filed with the court and it must be done accurately and in a certain fashion. Failing to do it right can lead to disastrous results.

Under the current bankruptcy law, there are several deadlines for actions, and failure to perform these tasks on time will result in dismissal of your case. You need an attorney to make sure you meet these deadlines.

Plus think about what happens if something goes wrong? It’s a lot more expensive to hire an attorney to fix problems than it is to hire one at the start of your case.

Why you shouldn’t use a Petition Preparer or Paralegal Service?

I can’t say it strongly enough - DON’T GO TO THESE PEOPLE FOR HELP. These types of companies charge a small fee - anywhere from $100.00 to $400.00 - to prepare your petition. But if you use them, you are just throwing your money away. A paralegal cannot give you legal advice. A paralegal cannot represent you in court or talk to your creditors. All they can do is type your paperwork - which you could do all by yourself.
